Sashe na 305 na kundin tsarin mulkin Najeriya ya baiwa shugaban ƙasa damar sanya dokar ta ɓaci idan akwai babban rikici a jiha. To sai dai wannan sashe bai baiwa shugaban ƙasa damar ko ƙarfin iya dakatar ko cire gwamna ba.
Hasali ma sashen kundin tsarin mulki na 188 da na 189 dakatar da gwamna ko cire shi aiki ne na majalisar dokokin jihar.
Haka zalika sashen na 11 (4) na kundin tsarin mulkin ya baiwa majalisar dokokin ta ƙasa da ta ɗauki ayyukan majalisar dokokin jihar idan har majalisar dokokin sun kasa ko ba zasu iya gudanar da ayyukan su ba.
Kuma tsarin mulkin Najeriya bai baiwa shugaban ƙasa damar dakatar da ayyukan majalisar dokokin jihar ba, domin kuwa yin hakan aiki ne na bangaren Shari’a da kuma majalisa ba harkar sashen zartaswa na ƙasa bane.

Sashe na 305 (3) wanda ya haɗa daga (a zuwa g) ya bayyana rikicin da ka iya sanyawa a ayyana dokar ta ɓaci.

- Idan ƙasa na cikin barazanar mamaya ko fadawa cikin yaƙi.
- Idan taɓarɓarwar doka da oda, rashin tabbas na tsaron lafiyar mutane a ƙasa ko wani sashe na ƙasa wanda dole a ɗauka mataki mai tsauri domin dawo da zaman lafiya.
- Idan akwai tabbacin wani haɗari na rashin bin doka da oda, wanda akwai buƙatar daƙile yiwuwar hakan.
- Idan haɗari, ko wani babban ibtila’i da ya sami wani yanki na ƙasa.
- Idan akwai kowanne irin matsala da ka iya yin barazana ga kasancewa Najeriya dunkulalliyar ƙasa.
- Idan shugaban ƙasa ya sami rokon buƙatar hakan, wanda yayi dai-dai da ƙaramin sashe na 4 cikin baka.
